No Increase for Security Gates and New Lighting

Landlord applied for MCI rent hikes based on a number of improvements, including the installation of interior/exterior lighting and iron security gates. The DRA disallowed any rent increase for these improvements, finding that the work didn't constitute MCIs. Landlord appealed. The DHCR ruled against landlord. The lighting and gates weren't required for the operation, preservation, and maintenance of the building structure. The fact that these new services were installed for safety reasons and eliminated a dangerous or hazardous condition didn't in itself qualify the work as an MCI.
