No Five-Year Test Tag on Elevator

DOB issued a violation notice to landlord for not maintaining an elevator in a safe condition. The violation stated that landlord didn't provide a stop switch and didn't attach a five-year test tag. The AU ruled for landlord and dismissed the violation because the stop switch wasn't required under the building code. DOB appealed because the ALJ hadn't ruled on the test tag issue. Landlord stated that a five-year test was done in 1993 but that the tag wasn't placed on the elevator until March 1996. ECB ruled for DOB and fined landlord $200.
