No Fees for Prior Proceedings

LVT Number: 8946

Landlord sued to evict tenants. The court ruled for tenants, and awarded them attorney's fees of approximately $79,000. The fees included the cost for prior eviction cases that tenants had won. Landlord appealed, arguing that tenants should get attorney's fees for the current case only. The court ruled for landlord, and reduced the attorney's fees to $38,000. Tenants hadn't asked for attorney's fees for the prior cases, so they'd given up the right to get them.
