No Certificate of Fitness for New Oil Burner

The fire department issued a violation notice to landlord for not getting a certificate of fitness for a newly installed oil burner. The ALJ fined landlord $300 since landlord still hadn't gotten the certificate of fitness by the time of the hearing two months later. Landlord appealed, claiming that it had applied to DOB for the missing certificate but that DOB didn't provide one. ECB ruled against landlord. Landlord didn't prove that the delay was DOB's fault. Landlord submitted no proof as to when it installed the oil burner or when it applied for the certificate.
