New Windows in Tenant's Apartment

Tenant filed a fair market rent appeal, claiming that the apartment's first stabilized rent was excessive. The DRA ruled for tenant and reduced his rent based on special rent guidelines and comparable apartments. Landlord appealed, claiming that the DRA didn't include the cost of apartment improvements in calculating the fair market rent. The DHCR ruled for landlord and allowed the cost of six new windows, including installation costs, to be included in calculation of the first stabilized rent.
