Tenant complained of a rent overcharge, claiming that landlord charged her $109.64 per month for renovations that hadn't been done. Landlord argued that it had spent $7,000 in labor when it completely rehabilitated the apartment after the prior tenant moved out. A DHCR inspection revealed that most of the repair work was done to correct outstanding violations. The DRA ruled for tenant, and landlord appealed. Landlord wins, in part. Landlord gets a rent increase for the new windows, and for the new bathroom vanity it installed.
