New Toilets Installed Building-Wide

Landlord applied for MCI rent hikes based on plumbing and repiping, including installation of new toilets. The DRA ruled for landlord and tenants appealed. They claimed that landlord had installed new toilets in 1995, just six years before the new installation in 2001. They argued that the useful life of the older fixtures hadn't expired. The DHCR ruled against tenants. The 1995 toilets were installed under a toilet rebate program, but no MCI increase was issued. Since no MCI increase was issued in 1995, landlord was entitled to an increase for the 2001 installation.
