New Staircase Connected with Concrete Replacement

Landlord applied for MCI rent hikes based on the installation of concrete and the addition of a new staircase. The DRA ruled for landlord in part, granting an increase for the concrete removal and replacement. The DRA disallowed any increase for the staircase because it was installed before the concrete was replaced. Landlord appealed and won. Landlord explained that the staircase was installed in connection with the concrete replacement. But the staircase had to be installed first to ensure that all holes around it would be properly filled.
