Landlord applied for MCI rent hikes based on the installation of a new oil tank. The DRA ruled for landlord. Tenant appealed, claiming that he received inadequate heat before the installation and that the new oil tank didn't correct this condition. Landlord submitted HPD records showing that there were no heat violations at the building. The DHCR ruled against tenant. Tenant submitted no sufficient proof to revoke the MCI rent hike. Tenant also never filed any complaint with the DHCR based on inadequate heat.
