New Mixing Valve Installed to Regulate Water Temperature

Tenant complained of a reduction in services, claiming that the bathtub mixing valve wasn't properly regulating the hot water temperature. The DRA ruled for tenant and reduced his rent. Landlord later applied to restore the rent based on restoration of services. The DRA ruled against landlord based on an inspection that showed a fluctuation between 80 degrees and 85 degrees in the bathtub water temperature. Landlord appealed and won. The complained-of condition was the broken mixing valve, which landlord had replaced. The DHCR's inspection report, in which a slight temperature fluctuation was noted, proved that the water temperature could now be regulated. So landlord had restored the service in question and could get a rent restoration.
