New Masonry Sleeves for A/Cs Not Required for MCI

Landlord applied for MCI rent hikes based on the installation of new air conditioners building-wide. The DHCR ruled against landlord because the installation didn't include new masonry sleeves. Landlord appealed, claiming that the DHCR's decision was unreasonable. The court ruled for landlord, and, upon reconsideration, landlord won. The DHCR agreed that the new units fit into the preexisting sleeves, so new sleeves weren't needed. The Rent Stabilization Code didn't require the installation of new masonry sleeves, and it was no longer the DHCR's policy to require them.
