Tenant complained of a rent overcharge, claiming that he paid $1,000 per month more than prior rent-stabilized tenant when he moved into the apartment, due to landlord's supposed renovations. The DRA ruled for tenant, finding some overcharge but permitting a rent increase for most of the improvements made by landlord. The DRA disallowed any increase for linoleum installation. Landlord appealed. The DHCR ruled against landlord.

A cost claim of $250 for what appeared to be the mere installation of a sheet of linoleum didn't warrant a rent increase without the installation of an entirely new floor, including subfloor, or an improvement such as parquet flooring.
