New Landlord Liable for Overcharge

A New Rochelle tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord claimed that prior landlord had told him that tenant's legal monthly rent was $235. But, prior landlord had unlawfully raised tenant's rent from $220 to $235, and tenant filed a timely overcharge complaint. The DHCR ruled against landlord. Landlord was responsible for prior landlord's overcharge. Landlord can't rely on what prior landlord put in the building's contract of sale.
