New Landlord Fined for Undocumented Sprinkler System

The Fire Department issued a violation notice to landlord for failing to maintain or produce records for a sprinkler system and failing to obtain or produce a certificate of fitness from the person maintaining the sprinkler system. Landlord claimed that it recently bought the building and that there was no sprinkler system, so there were no records to maintain. Landlord later discovered that there was a sprinkler system in the basement and corrected the conditions noted in the violation notice.

The ALJ fined landlord $1,450 since the violation was corrected after the cure notice was issued. Landlord appealed and lost. FDNY procedures permit a zero penalty only when a landlord properly submits a certificate of correction and proof of compliance by the cure date shown on the violation notice. Landlord failed to do so in this case, so the the fine was proper.
