Landlord applied for MCI rent hikes based on the installation of a new hot water heater. The DRA ruled for landlord, and tenant appealed. She claimed that the hot water heater was used, not new. She also claimed that the useful life of the prior hot water heater hadn't expired. The DHCR ruled against tenant. Landlord stated that the replaced hot water heater was 13 years old. The useful life of a hot water heater for MCI purposes is 10 years. And landlord submitted proof that the hot water heater it installed was new.
