New Garage Roof Qualifies as MCI

Landlord applied for MCI rent hikes based on the installation of a new garage roof. The DRA ruled against landlord, who appealed and won. The DRA had found that the garage wasn't an integral part of the apartment building, so it didn't qualify as an MCI. But landlord submitted a statement from its contractor that the garage roof was attached to, and part of, the building, and replacement was needed to maintain the structural integrity of the building. The DHCR granted the MCI increase.
