New Canopy Doesn't Qualify

Irvington landlord applied for MCI rent hikes, based on installation of a new entrance canopy. Landlord claimed the canopy qualified as an MCI because it was completed in conjunction with replacement of the building's entrance doors. The DRA denied landlord's application for the canopy, and landlord appealed. Landlord loses. Replacing an entrance canopy doesn't qualify for an MCI rent hike. It isn't building-wide and doesn't preserve the building, nor does it involve structural changes or replacement of a major building system.
