Landlord applied for MCI rent hikes based on the installation of a new boiler/burner. The DRA ruled against landlord because the useful life of the old boiler/burner hadn't expired. Landlord appealed. A licensed oil burner company had certified that the old boiler/burner was leaking and beyond repair. The DHCR ruled for landlord. The old boiler was only 11 years old, but landlord showed that it had to be replaced for emergency and safety reasons.
