Mistake on Registration

LVT Number: 11086

Tenant complained of a rent overcharge. The DRA found no overcharge and ruled against tenant. Tenant appealed, claiming that the initial rent registration statement (RR-1) served on prior tenant was fraudulent. The DHCR ruled against tenant. The apartment was vacant on April 1, 1984, while being renovated. Prior tenant moved in on May 1, 1984, at a monthly rent of $3,600. Landlord incorrectly stated on the RR-1 form that the rent was $3,600 on April 1 instead of on May 1. This mistake didn't matter. Prior tenant was served with the RR-1 and never objected.

And tenant wasn't hurt by the mistake. The amount of the registered rent was proper; only the date was incorrect. There was no requirement that the rent prior to April 1, 1984, be listed on the RR-1 form.
