Mismatched Kitchen Tiles

Tenant complained of a reduction in services based on mismatched kitchen tiles. The DRA ruled for tenant, and landlord appealed. Landlord claimed that this was a minor condition that didn't warrant a rent reduction. The DHCR ruled for landlord. Landlord submitted a sworn statement from its managing agent stating that the tiles all came from the same manufacturer and were simply different shades of the same color. Landlord also put most of the different shaded tiles under the stove, out of sight.

Since landlord made a good-faith effort to match the tiles, and they were only of slightly different shading, no rent reduction was warranted.
