Metering Conversion Results in $35 Rent Reduction

Landlord asked the DHCR for permission to convert from master gas metering for cooking gas usage to individual gas metering in rent-controlled tenant’s apartment. Landlord agreed to a rent reduction in exchange for the switch. The DRA ruled for landlord and ordered a $35 rent reduction. Landlord appealed and pointed out that it paid $28 to $38 every two months for gas and that tenant’s maximum collectible rent was $73 per month. The DHCR ruled against landlord.

Landlord appealed and pointed out that it paid $28 to $38 every two months for gas and that tenant’s maximum collectible rent was $73 per month. The DHCR ruled against landlord. The amount of the rent reduction ordered by the DRA was based on the estimated minimum gas usage charged by a KEYSPAN representative at the time of landlord’s application. The amount of the rent reduction required for the conversion therefore was reasonable.
