Landlord applied for MCI rent hikes based on an elevator service upgrade. The DRA ruled against landlord. While its MCI application was pending, the DRA had instructed landlord to file an application for modification of services. But landlord failed to do so. Landlord appealed and won. Landlord had responded to the DHCR's instruction by submitting proof that no conversion to automatic operation was made to the elevator. Therefore, no service modification application was needed. With its PAR, landlord submitted proof of mailing this response to the DRA.
