MCI Rent Hike Granted for New Trash Compactor

Landlord applied for MCI rent hikes based on installation of building-wide windows and a new compactor. The DRA ruled for landlord, granting MCI rent increases. Tenant appealed and lost. Tenant claimed that no new windows were installed in her apartment, and that there was no change in the way that refuse was disposed. But the reason that windows weren't installed in tenant's apartment was that tenant wouldn't allow access for the installation. And landlord intended to install the purchased windows as soon as tenant permitted it to do so.

An MCI increase also was granted for installation of the compactor, not for a new system of refuse disposal. The fact that tenants may still use the preexisting trash chute and must still carry recycling refuse down to the first floor presents no proof that the newly installed compactor itself didn't operate properly.
