MCI Rent Hike Granted for New Boiler

The DRA granted landlord's application for MCI rent hikes based on the installation of a new boiler. Tenants appealed and lost. They claimed that the boiler installation was merely maintenance and repair work made necessary by landlord's years of neglect. The old boiler was defective and the subject of repeated violations. They also claimed that the installed boiler wasn't new but merely rehabilitated. But the fact that the old boiler may have been replaced to correct defective conditions didn't bar an MCI rent hike.
