MCI Rent Hike Granted for Handicap Ramp

LVT Number: #23191

Landlord applied for MCI rent hikes based on the installation of handicapped accessibility ramps at its building. The DRA ruled for landlord in part, disallowing certain costs deemed unnecessary or inadequately documented. These were $28,875 for fence work deemed unrelated to the MCI and $167,500 of construction costs that were not broken down. Landlord appealed and lost. Although landlord claimed that the Landmarks Preservation Commission required the fencing, there was no reference to this in any documentation landlord submitted.

As to the disallowed construction costs, the DRA repeatedly asked for further information to determine if certain portions of the claimed costs were ineligible or duplicative work. Landlord didn't submit the requested information.
