MCI Rent Hike Granted for Elevator Upgrades

Landlord applied for MCI rent hikes based on two elevator upgrades. The DRA ruled for landlord. Tenant appealed and lost. Tenant claimed that the work was merely a repair since no infrared detectors or additional communication devices were installed on the elevator doors. Tenant also said there were DOB violations on file for the elevators and that they didn't work properly. But DOB had signed off on the elevator installation, and tenant couldn't raise the issues he now raised for the first time on appeal.
