MCI Increase Granted for Handicapped Accessibility Lift

Landlord applied for MCI rent hikes based on installation of mailboxes and storage room doors. But the DRA disallowed other costs associated with lobby renovations as well as the cost of a new canopy and hallway carpeting that was covered by insurance proceeds. Landlord appealed and won, in part. Landlord claimed that it had installed new doors in the lobby, but landlord's documents indicated only that existing doors were relocated. Also, no new security cameras or intercom system was installed; existing items were simply moved.

Landlord also failed to submit requested documentation to show how much of the carpeting was covered by insurance reimbursement after a hallway fire. But landlord's installation of a handicapped accessibility lift to provide accessibility to the mailboxes and elevators qualified as an MCI as it provided access after lobby renovations.
