MCI Increase Granted for Elevator Upgrade

The DRA granted landlord's application for MCI rent hikes based on elevator upgrading. Tenants appealed and lost. Tenants argued that the elevator work was needed because landlord had failed to maintain the elevators. But that didn't matter. Elevator upgrading, including the installation of a new controller and selector, is an MCI under longstanding DHCR policy.

The DRA granted landlord's application for MCI rent hikes based on elevator upgrading. Tenants appealed and lost. Tenants argued that the elevator work was needed because landlord had failed to maintain the elevators. But that didn't matter. Elevator upgrading, including the installation of a new controller and selector, is an MCI under longstanding DHCR policy. Landlord submitted all required proof of the improvement, including contractor specifications, contractor affidavit of cost breakdown, contractor's certifications, cancelled checks, and required governmental approvals and sign-offs.
