Loose Rubbish Came from Building Next Door

DOS issued a violation notice to landlord for leaving loose rubbish out for collection. The DOS inspector saw eight pieces of wood, not securely bundled or tied, and likely to be scattered, in front of landlord's building. Landlord claimed that the wood didn't come from his building. The ALJ ruled against landlord and fined him $100. Landlord appealed and won. Landlord had credibly testified that tenants in the building next door had moved out that morning and left the wood in front of his building. The fine was revoked.
