Landlord sued to evict loft tenant. Landlord claimed that the loft was unregulated because landlord had bought prior tenant's rights under MDL §286(12). Tenant claimed that he was rent stabilized. The court ruled for tenant and dismissed the case. Landlord appealed and lost. The building had six or more legal residential units. And tenant's unit had been converted legally into a residential unit. So it didn't matter if landlord bought prior tenant's rights. The unit was subject to rent stabilization separately, not under the Loft Law.
