Loft Building Becomes Subject to Rent Stabilization

The Loft Board directed landlord to issue rent-stabilized leases to two tenants in the building subject to the loft law. Landlord appealed, claiming that since there were only four loft units in the building, rent stabilization shouldn't apply because the Rent Stabilization Law applies only to buildings with six or more units. The court ruled against landlord. The purpose of the loft law is to provide rent stabilization coverage to residential loft tenants.

Landlord appealed, claiming that since there were only four loft units in the building, rent stabilization shouldn't apply because the Rent Stabilization Law applies only to buildings with six or more units. The court ruled against landlord. The purpose of the loft law is to provide rent stabilization coverage to residential loft tenants. And Multiple Dwelling Law section 286(6) states that residential loft tenants in buildings with less than six units are covered by rent stabilization unless they sell their loft fixtures.
