Landlord sued to evict loft tenant. Landlord claimed tenant was deregulated because prior tenant sold current tenant his loft law rights. This removed the loft from loft law regulation. Tenant claimed the apartment was rent-stabilized because the building was otherwise subject to the ETPA. The court ruled for tenant and dismissed the case. Even though loft law coverage had ended for the unit, a loft could be rent stabilized if the building was otherwise subject to the ETPA.
