Lobby Work Found Unrelated to MCI Door Installations

Landlord applied for MCI rent hikes based on the installation of new entrance and vestibule doors, new rear entrance doors, rear entrance blacktop, intercom panel replacement, lobby terrazzo honing and patching, and lobby renovation related to the door installations.

Landlord applied for MCI rent hikes based on the installation of new entrance and vestibule doors, new rear entrance doors, rear entrance blacktop, intercom panel replacement, lobby terrazzo honing and patching, and lobby renovation related to the door installations. The DRA ruled for landlord in part but disallowed any MCI increase for the lobby restoration, blacktop installation, and lobby floor terrazzo work because it didn’t qualify. Landlord appealed and lost. Landlord claimed that the lobby restoration and floor work were related to the new door installations. But this work was done between six and nine months before the door installations. Landlord therefore didn’t show that the work was done in connection with and directly related to the door installations.
