Lobby Work Didn't Qualify as MCIs

The DRA granted landlord's application for MCI rent hikes based on the installation of a new intercom, security cameras, and a new vestibule door, but disallowed some other costs for lobby work. Landlord appealed and lost. Electrical wiring, plumbing work, and new flooring were done in the lobby area only and not on a building-wide basis. Stairway work, described as "lobby steel work," also wasn't done on a building-wide basis as not all of the stairways in the building were rebuilt.

Installation of new mailboxes didn't qualify since the mailboxes weren't moved to a different, more secure, area. The disallowed items all were ordinary repairs, not major capital improvements.
