Lobby Constitutes Seventh Story to Building

DOB issued violation notices to landlord for not submitting a facade inspection report. This requirement applied to buildings that were more than six stories in height. Landlord claimed that the building wasn't more than six stories. The inspector claimed that the lobby level made the building more than six stories tall. The ALJ ruled for DOB and fined landlord $3,400. Landlord appealed and lost. DOB showed that half the lobby level was above ground. There were six additional stories. So the building was more than six stories high.
