Litter ‘Matted Down'

The DOS issued a violation notice to landlord for not cleaning 18 inches into the street. The notice stated that the litter was ``matted down.'' Landlord argued that he cleaned the sidewalk everyday at 11 a.m. and at 4 p.m. Landlord noted that parked cars made it difficult to clean the curb area. The ALJ ruled against landlord, and fined him $50. Landlord appealed, and the ECB again ruled against landlord. The fact that the litter was matted down showed that landlord's cleaning efforts weren't sufficient.
