Lightning Damaged Parapet Wall

The DOB issued a violation notice to landlord for not maintaining a parapet wall on top of its building. Lightning had struck and knocked out a section of the wall. Landlord claimed that repairs were made within one day after the violation notice was issued. The ALJ still held landlord responsible and fined landlord $500 for this hazardous condition. Landlord appealed, and the ECB revoked the violation and the fine. Thunderstorms had occurred the day before the violation notice was issued.

Landlord contacted a contractor on the day of the violation notice, and repairs were made by the next day. Landlord took reasonable steps to quickly repair the defective condition.
