Lead Paint Abatement in Vacant Apartment

Landlord asked the DHCR if work done to abate lead paint in a vacant apartment qualified for an individual apartment improvement increase. In an opinion letter, the DHCR said yes. If the work was done in a vacant apartment, landlord would be entitled to a 1/40th rent increase. However, the DHCR pointed out that it hadn't determined whether landlord could collect a rent increase for lead paint abatement work under other circumstances.
