Late Registration of Three Apartments

LVT Number: 14573

(Decision submitted by James R. Marino of the Manhattan law firm of Kucker & Bruh, LLP, attorneys for the landlord.) Landlord applied for MCI rent hikes based on elevator upgrading. The DRA ruled for landlord, but disallowed rent increases for six apartments that were registered late. Landlord appealed, showing that three of the six apartments were rent-controlled. No annual registrations were required for those apartments after the initial 1984 registration, which landlord had done. Landlord also had completed the late registration of the three missing rent-stabilized apartments.

So landlord was entitled to MCI increases for these three apartments as of the first rent payment date after the late registrations were filed.
