Landlord's Proof of Apartment Improvements Illegible and Inconsistent

Tenant complained of a rent overcharge. The DRA ruled for tenant and disallowed any increase for a portion of landlord's claimed individual apartment improvements. The DRA also froze tenant's rent based on landlord's failure to register the apartment in 2006. Landlord appealed, claiming that the DRA didn't give it enough chance to submit sufficient proof of the improvements. Landlord also submitted proof of a completed 2006 rent registration.

The DRA also froze tenant's rent based on landlord's failure to register the apartment in 2006. Landlord appealed, claiming that the DRA didn't give it enough chance to submit sufficient proof of the improvements. Landlord also submitted proof of a completed 2006 rent registration.
The DHCR ruled against landlord. The DRA notified landlord several times that its proof of apartment improvements wasn't clear, and requested additional information. Landlord didn't respond to those requests. The total price on landlord's invoices didn't match the total on landlord's checks. The check amounts were greater than the amounts on the invoices. A check made out to one vendor didn't show that it was cashed, and the $3,000 amount of the check wasn't reflected in the invoice. Parts of the invoice also were illegible, and the copied invoice was missing part of the original document. As for the 2006 registration, this wasn't filed until after the DRA issued its order. So the rent remained frozen through the date of the DRA order.
