Landlord's Ignorance of New DOS Mattress Rules No Defense

DOS issued a violation notice to landlord for improper disposal of bedding. The DOS inspector saw a mattress placed out for collection without being placed in a securely sealed bag. Landlord claimed that she didn't know she was required to do so. The ALJ ruled against landlord and fined her $100. Landlord appealed and lost. DOS rules were changed in December 2010 to require anyone disposing of bedding for DOS collection to securely seal it in a plastic bag. The fact that landlord didn't know the law had changed was no excuse for the violation.
