Landlord's Claim That Tenant Rejected New Stove Offered Was Untimely

Rent-stabilized tenant complained of a reduction in services because of a defective stove. The DRA ruled for tenant and reduced his rent. Landlord appealed and lost. Landlord claimed that tenant wouldn't permit installation of a new white stove because tenant wanted a stainless-steel appliance. But DHCR inspection showed that the ignition on the existing stove didn't work. And, in answer to tenant's complaint, landlord had claimed that all repair work was completed to tenant's satisfaction. The DHCR couldn't consider new facts on appeal.
