Landlord's Application for Parapet Work Filed Too Late

The DRA denied landlord’s application for MCI rent hikes based on a new parapet and parapet fence. Landlord appealed and lost. The parapet was completed more than two years before the filing date of the MCI application. And the parapet fence wasn’t an improvement, but merely repair and maintenance work. Landlord argued that the parapet and fence were part of one installation and, since the parapet fence was completed less than two years before the application was filed, it was timely.
