Landlord Wasn't Given Enough Time to Clean

The DOS issued a violation notice to landlord for a dirty sidewalk. A building tenant testified at the ECB hearing that the violation was issued about a half-hour after a sanitation worker broke a garbage bag put out for collection and then left without cleaning up the garbage that spilled out. The ALJ fined landlord $50, and landlord appealed. The ECB dismissed the violation. It found that landlord was responsible for cleaning the garbage left by the sanitation worker, but landlord wasn't given a reasonable time to clean it up.
