Landlord-Tenant Relationship Existed

LVT Number: 15915

Facts:Landlord sued to eject occupant who he claimed was residing illegally in the building's basement. Occupant claimed that he had signed a contract with landlord to buy the building and that landlord violated the contract. Occupant asked the court to dismiss the case. He claimed that landlord didn't send a 30-day termination notice and, so, hadn't properly started the court case. Court:Occupant loses. There was no proof of any landlord-tenant relationship between landlord and occupant. So landlord was entitled to bring an ejectment action without first sending a termination notice.
