Landlord Switched Elevator Service from Manual to Automatic Without DHCR Permission

Tenant complained of a reduction in building-wide services after landlord removed 24-hour elevator operators. The DRA ruled for tenant and reduced his rent. Landlord appealed and lost. Landlord did file an application requesting DHCR approval of building service upgrades, including a change from manual to automatic elevator service, advanced door locking mechanisms, two-full time doormen, and a lobby attendant. But this application was pending and was filed after the elevator service was changed.

But this application was pending and was filed after the elevator service was changed. So the rent reduction order must remain in place until and unless the DHCR decided the service modification application in landlord's favor.
