Landlord Swept Twice Daily

DOS issued a violation notice to landlord for not sweeping in front of her building. Landlord claimed she did sweep. The ALJ ruled against landlord, and landlord appealed. ECB reversed and ruled for landlord. Landlord showed that the curb area was swept on the day the violation notice was issued. Landlord also showed that the street was a quiet residential block, that the building was a three-story brownstone, and that the area was swept at least twice daily. Landlord showed that sufficient efforts were made to keep the curb clean.
