Landlord Submitted O&M Certification on Time

The DRA granted landlord eligibility to raise MBRs for 1990/91. However, eligibility was delayed from January 1, 1990, to April 1, 1990. The DRA found that landlord didn't file a copy of the Operations and Maintenance and Essential Services (O&M) certification on time. Landlord appealed, claiming that the O&M certification was filed on time. The DHCR ruled for landlord. A review of the DHCR's own records showed that landlord submitted the O&M certification on time and that it was logged in and placed in the file by a DHCR employee.
