Landlord Should Have Filed Affidavit that Fuel Tanks Were Sealed

Fire Department issued a violation notice to landlord for not filing a sworn statement that the fuel tank had been properly sealed, in violation of Fire Rule 19. Landlord claimed that the sealing affidavit should have been filed by its contractor. The ALJ ruled against landlord and fined it $225. Landlord appealed. ECB ruled against landlord. While landlord's contractor should have prepared the affidavit, it was landlord's responsibility to file it.
