Landlord Restored Electric Outlet for Working Stove

LVT Number: #25035

Rent-stabilized tenant complained of a reduction in services. The DRA ruled for tenant and reduced her rent, based on a finding that the electrical outlet for tenant's stove wasn't working. Landlord later applied for rent restoration based on the restoration of services. The DRA ruled for landlord and restored tenant's rent. Tenant appealed and lost. DHCR inspection showed that there was a functioning 220 electric outlet provided for the stove that tenant had bought, and that the stovetop and broiler were working properly.

An HPD violation that the DRA cited in its rent reduction order also was no longer open. Tenant argued that DOB had issued a stove receptacle violation. But that violation wasn't an issue presented before the DRA and therefore can't be considered at this point.
